Sanjay Dutt & The Bendy Bananas




Ever seen a straight Banana? No? I found a rare one in the pic. Next time you buy bananas try and find one without a curve. Great democracies are known not just for the Constitution or Independence but for their justice systems and their citizens to accept that justice system. Last year Rajat Gupta was sentenced to two years in prison for an insider trading racket in the US. Tears were flowing like rivers in the Indian media. The court did tell Gupta he may have done a lot of good things but it has no option to sentence him for his crime. Unless he wins an appeal Gupta will indeed go to prison. There’s the case of former British MP Jeffrey Archer. He is also a very successful writer whose books have sold over 200 million copies. In 2001 he was sentenced to four years in prison for perjury in a 1987 libel case which he won. Archer served two years before being released and had returned the 5Lakh Pounds he had won in the libel case, with interest. To say that both these gentlemen are celebrities would be an understatement.

It is, therefore, not surprising that in a growing Democracy like India there are “Bendy Bananas” in the form of celebrities who are hell bent in turning India into a Banana republic. Theirs is the loudest clamour for mercy and pardon to Sanjay Dutt for his crime and 5-year sentence. Over the last decade the justice system in India has rotted along with other democratic institutions. In less than 24 hours of the Supreme Court verdict on SD a former judge Markandey Katju wrote an open letter to the Governor of Maharashtra to pardon Sanjay Dutt because he has suffered enough for the last 20 years. By that he means the 20 years it took to reach a final verdict in the Bombay blasts of 1993. Justice Katju… Er… let me correct that, it should be “Private Citizen Katju” (PCK), since he claims all his opinions now are as a private citizen and not as a former Justice or his current position as PCI Chairman. I wonder if PCK had even taken the trouble of reading the judgement before he appealed for a pardon. Having sent off that appeal PCK was on all media channels defending his worthless act and even walking off angrily from TV discussions. This is what PCK wrote in his appeal:

The power of pardon under Article 161 by the Constitution is different from the judicial power. The Governor/President can grant pardon or reduce the sentence of the Court, even if a minimum is prescribed. Hence there is no doubt that the Governor can grant pardon/reduce the sentence”.

And among other things PCK also writes:

The event happen in 1993 i.e. 20 years ago. During this period Sanjay suffered a lot, and had a cloud hovering over his head throughout. He had to undergo various tribulations and indignities during this period. He had to go to Court often, he had to take the permission of the Court for foreign shootings, he could not get bank loans, etc… Sanjay in this period of 20 years has through his film revived the memory of Mahatma Gandhi and the message of Gandhiji, the father of the nation”.

Ever read anything more idiotic and silly? But that was enough to send a whole lot of other parliamentarians and Congress members to scream “pardon”. Even legal-bimbos were talking about appealing to the Maharashtra Governor for the pardon. This is apart from the whole Bollywood mafia which feels Sanjay Dutt is a victim, innocent, made a foolish mistake, is a kind-hearted soul. I’m sure SD is all that to his friends and people who know him. The law is not in the movie-making business. This is what his friends and PCK don’t wish to acknowledge. And how did SD struggle and suffer for 20 years? Oh well, if you didn’t know, he made over 90 movies during this 20 year period. At a miserly average of 50 Lakhs per movie that would be 45 Crores! Super stars in Bollywood are paid in crores not lakhs though. I wonder why SD even needed bank loans. Never mind!

PCK is foolish and even moronic to suggest that SD has revived the memory of Gandhiji. I am surprised this is the nonsense with which he appeals for pardon (or maybe I shouldn’t be surprised anymore). Even though this moronic suggestion has to be laughed at and dismissed, PCK should know that the message of a movie is essentially a message of the Director and not the actors. The actors just play the part. It is the Director who tells the story through his vision and imagination. Never mind that. If indeed someone has made Gandhi popular across the world then it has to be Ben Kingsley. He won an Oscar award for that role so maybe according to PCK Kingsley should be provided complete and permanent immunity from any prosecution for any crime for a lifetime. And this comes from PCK, a man who claims he hasn’t seen a movie in 40 years (how can you possibly be an Indian if you haven’t seen movies for 40 years? For that alone PCK should be prosecuted) and has never met SD.

The media picked up the nonsense of PCK and peddled it all through the last three days. Naturally, the editors everywhere didn’t even bother to check if what PCK was saying was really factual or had any merit. They never checked if a Governor did indeed have the power to pardon SD. Well, in the movie I saw last evening (State of Play) the editor has a sign on her desk that says “Never trust an editor”. If you look at the headline and tweet by NDTV you would be led to believe SD was prosecuted for just having a small, illegal gun for self-defence. I guess by now everyone knows that SD ferried, possessed and latter destroyed weapons enough to start an attack quite similar to 26/11. He also had a large cache of cartridges and grenades. This is how our Bendy Bananas twist the story. But that isn’t important. 

The SC has taken everything into account and pronounced its judgement. Does the Governor really have power under Article 161 to pardon SD’s crime? Here’s what Mahesh Jethmalani, another prominent lawyer, had to say:

"While it is the personal prerogative of any citizen of this country to campaign for a pardon for any convict -notwithstanding the dubious company the convict might have kept, both before and after the cataclysmic events that had shaken Bombay on 12th March, 1993, citizens are entitled to expect a modicum of elementary homework at least by such distinguished personalities as Messrs Katju, Ashwini Kumar and Manish Tiwari… The executive power of the state government does not extend to matters enumerated in the Union list of the 7th Schedule of the Constitution of India. Entry 5 in the Union List consists of arms, firearms, ammunition and explosives. The Arms Act is a statute enacted by Parliament. The Governor's power of pardon under Article 161 of the Constitution of India, accordingly, does not extend to the sentence of any person convicted under the Arms Act”.

It’s really hard to find a “straight” banana; curves seem natural to this loveable fruit. Therefore, the European Union decided how much curve is acceptable and passed a “Bendy Banana” law in 1995. Good democracies are worried about how curved Bananas should be. The sinking ones are turning into Bananas themselves. It specifies, among other things, “minimum standards for specific quality classifications of bananas (Extra, Class I, Class II). Only Extra class bananas have to comply fully with the shape specifications. Class II bananas, for instance are permitted to have "defects of shape"; Class I bananas are permitted only "slight defects of shape". Hmm! You see, we Class-2 bananas are extended some latitude for our ignorance and curves because we aren’t judges and celebrities. What about the Class-1 bananas? They are permitted only “slight” defects but in India these celebrities or “Bendy Bananas” seem to twist and grind the law out of shape all the time. The bigger the celebrity the bigger the twists and curves it seems. I have to agree with what the apple says to one such very “Bendy Banana” whose “opinions” are starting to stink.

    After the new malnutrition statistics blowing in the face of these paid media agents which show Gujarat as the most improved state with respect to malnutrition, MSM had to find some meaningless news and run the charade.If Sanjay Dutt was not a film star and certainly not the son of popular film star, what would have been his fate.
    It is astonishing to see hero worship at such leves even more common people who still believe SD is innoncent or because he is kind, he should be let off!
    As for Katju, thank god now the MSM is scurrying for shelter, remember The Hindu gave platform to his rantings and must certainly be embarassed at this motormouth.

  7. Its very evident that the gov under no circumstances can pardon sanjay dutt. What baffles (and I refuse to accept) me is the fact that justice katju does not know this basic fact. Therefore we shud take this argument forward from the premise that inspite of justice katju knowing something which is not possible why is he doing this. The obvious answer, as I see, is that katju likes being in news even if it means doing so at the cost of spreading nonsense and making himself look like a complete ass. What katju also knows is the fact that this is india, no matter how moronic your arguments and observations are, there is a certain section of our society (media included) which will buy it

PCK is the most apt acronym to describe him indeed - for this perfectly rhymes with what sane, nationalists would like to call him. For what is implied / missing in the acronym is Rigorous Imprisonment (RI) - something not only Sanjay Dutt deserves but this sicko as well!

    Thanks for this well,nice article.I can understand the judiciary system now.There would be many more 'Morons' like Katju.We got to know this one because he has foot in his mouth.And now I understand if so called 'Eminent SC judge' don't have knowledge of Law,what would be state of others and what kind of justice we can expect from Judiciary.It'a a travesty of justice that it took 20 long years to convict a Criminal.Once again Khangress and it's brigade of Pseudo-seculars have proved that they can go to any level to sell this country.They run constant campaign against NaMo for a crime he was never involved. Sanjay Dutt is Pseudo-secular when he was carrying weapons of Mass destruction.Guys do remember all this. Next mercy plea will be for Gopal Kanda (Geetika Sharma suicide) case and many more....That's why I said,no matter of comment on FB,twitter are going to solve our problems.We all patriots have to start 'Second freedom fight movement' against these Pseudo-seculars.......

According to Times of India Ram Jethmalani says Governor has no powers to pardon Sanjay Dutt whereas Katju asks Governor to pardon.Whoever is right fact is one of them has forgotten law.The question is why waste court's time and tax payers money if judgements are not enforced.Might as well send all cases to the Governor and dismantle all the courts

  16. If the Ex- SC judge himself is unaware of laws, and then biased to particular section of a society..we hardly know if similar jokers are practicing right now in our judiciary... There should be 4 different laws-1. foreigners - with assurance of no death penalty, 5 star staying facility, and return back to Native country after conviction. 2. Politicians- No law can affect them as Police and CBI works for them, as in last 65 years CBI could hardily prosecute more than three Ministers. 3. Celebrities/corporate- these are manufactured media puppets, who work for corporate interest fooling everybody in our country including a Ex- SC judge who didnt even saw movie for last 40 yrs. 4. Law for common man-: Like SD driver was sentese to 10 yrs just for transporting those ammunition. there are 2.5 lacs under trails in prison right now, some of them for more than 5 yrs. Judiciary is main problem of India, as It takes more time to gives it judgment 20 Yrs for SD for Possession of arms, poaching case of 1998 is still in court,others like Salman hit and run.. People have lost their faith in functioning of judiciary.

      Why should SD's driver get 10 years and SD just 5 years. SD's driver was following his master's duty and in spur of the moment, he followed his masters order, thinking his master would save him in case of eventuality. This is what we all do.
      When we write software, do we know how sales people are going to use it. They may use for illegal purposes. This is like blaming the engineer more who wrote software without knowing the evils than the person who actually had nefarious intention.

  17. Sanjay Dutt had three AK 56 , hand grenades & ammo stored in his house. he helped hatch the 1993 conspiracy. In contrast Kasab had one(im guessing). To put it POINT BLANK Sanjay Dutt was a criminal.
    Even on bail , he was in touch with his bosses in Dubai, and everybody is asking pardon for him like it was a hungry beggar stealing bread. It seems he was thirsty for blood rather. He has said that the guns and ammo was to be used when there will be a backlash after the bomb blasts. Sanjay Dutt and team should in fact be charged with Treason and waging War against the nation. This my friends is the son of "Mother India" !!!!
    I find it funny when some people argue that Sanju Baba had weapons to protect his family from the riots of Babri. Ironically he acquired these weapons 2 months after the riots. And it is even more Ironic that a Son of a Sitting MP of then ruling congress resorted to "seeking protection" from the Anti-national elements rather than the police. A sitting MP can anyways get Z-security.

    We should not wait any further and send him to jail right away lest he run away like the italian marines.

In all MSM debates over the last few days since the conviction,celebrities and pseudo secular netas start with great patriotic thoughts in this case and suddenly there comes a 'but' or 'at the same time' or 'having said that' and then begins the spin.These conjuctions are now the most dreaded words for a law abiding nationalist today.The debate then goes on and on shamelessly bordering around blatant treachery.Imagine rescuing somebody for having promoted Gandhism in a movie.Katju could be the next in line for a bharat ratna.

  23. I like SD and I loved him in 'Lage Raho Munnabhai'. That doesn't mean I should join the stupid clamour for pardon for him in a criminal case in which the apex court of the land has slapped on him a five year prison term. This Katju move is just the tip of a hidden iceberg. For sure, there are other political heavy-weights secretly pulling strings in Delhi and Mumbai. I won't therefore be surprised if SD ultimately goes scot-free. And if that happens, then we should as well seek pardon for Memon. I know people who worship even Dawood for his extreme 'kindness'. She has managed to manipulate all democratic, bureaucratic, and judicial institutions and as you said the fourth estate is simply dancing to her tunes. Her agents and cronies have penetrated each and every center of power and by every passing day are swarming around executing her plans to destroy this country. Further, if Sanjay Dutt can be pardoned then why leave our famous Dawood Ibrahim. The media inspite of all good things done by Modi was vocal about giving him capital punishment. Media is surely going all nuts.... credibility of Indian law is at stake... what a travesty of Indian justice system or heights of sycophancy

I agree with you,But just see around and find that most of the Governors appointed by the UPA are people who are senile and need mental check for themselves on a daily basis.Few cases in point is N.D.Tiwari,Hansraj Bharatwaj,S.M.Krishna.The Maharastra Governor Shankaranarayan is also in the same class and found medically unfit for any further political career when he was recommended for the office of Governor.These people can easily be coaxed into doing anything.

  38. i expected your column on this. but these people are helpless. the "celebrities(!!!)(as i personally don't believe in any such thing like celebrity or star)" made money. everyone knows which money runs our film industry whether it is south or bollywood. and it is this money that made them speak for sanjay dutt as a huge amount has already been invested on sanjay dutt. now it is the duty of these people who directly or indirectly benefited from such money to free "the horse". just remember the "Bharat Shah" case. everyone knows whose money he handles.

If true then its a gigantic loss for all of us whose voice was Ravi and way he articulated the hypocricy of high and mighty was legendary. I hope I am wrong and we still get to see Ravi fighting it out the way he hdid and inspired so many amongst us to become blogger and vent out the frustration there.

  44. It is hard to imagine that Mr Katju was a judge of HSC. Apparently, all those affidavits, appeals and various other court documents, that would've called him hon'ble, excellence, knowledgeable and so on, have gone straight to his head. This is a first I guess, a retired judge making the mockery of the judgement of HSC by almost insinuating the HSC erred in awarding the punishment. Isn't this a case for contempt?

    The explanation by Mr Mahesh Jethmalani regarding applicability of power of pardon under article 161 is pretty apt. BUT, the problem is we are class II indeed. It is very much possible that a pardon may be granted and all the hullabaloo over interpretation may be completely smothered by MSM through barrage of pro pardon jugglery.

    The main question that has been side lined very cleverly, just because names of some political figures would prop out. - question is "FOR WHOM Sanjay Dutt has taken this arms delivery?" We must not just rubbish his argument ofself denfese but we must press for 3rd degree to extract from him as for whom he took that delivery?
    Remember Underworld wanted to secure their funds by marrying him off under Goa Marriage ac and failed.

    We have heard stories of actors coming lateon their film shoots, but have you ever heard any actor coming late for Stage Shows or Ad shoots?? NO. Because most of the films are financed by underworld and the people who extract money from society will pay honestly to Actors !! Just Impossible. Just imagine guys the extras who gets paid 300 to 700 per day had to form Union so that Producers do not end up eating their daily wages. You think Actors gets paid? It is easy to understand that why even one year without a movie and actor's cheques starts bouncing. Its easy to understand that had the actors been paid nicely, they would have paid the taxes as per the income shown in their statements. But the inflated figures are being propagated so that the heavy losses can be shown and tax on the income earned somewhere else can be evaded.
    People are scared to deliver / sell things to bollywood because they are afraid of recoveries. Guys its a big false that they get paid in crors.
    Mags were saying that Mannat was costing 3 cror. The same Mags were saying that in between SRK had to sign several wrong movies cos he wanted to purchase Mannat. Now the actor who is getting paid 5 Cr a movie why would he sign SEVERAL wrong movies for a bunglow of just 3 Crs? Any Car gifted to any star can be seen back in the showroom .. its a big false business guys.
