The Batla House Deception



Yesterday evening, after the Batla Encounter verdict, Congress spokie Abhishek Singhvi came out and stated the verdict should not be politicised. Ahem! He demonstrated the hypocrisy of his party like no one else could have done. For 5 years some Congressmen have done nothing but politicise it. Digvijaya Singh called the encounter fake many times and even visited Azamgarh to rake up the issue politically. Salman Khurshid during the UP 2012 campaign said there were tears in SoniaG’s eyes on seeing Batla House images. All of them thoughtlessly tarred the reputation of a police officer, Mohan Chand Sharma, who was killed in the encounter. This continued even after former Home Minister P. Chidambaram maintained the encounter was not fake and even NHRC (National Human Rights Commission) shared their agreement on it.

So let me lay out the story which I presume the hacktivists and professional agitators would have us believe. On the fine morning of September 19, 2008 Mohan Sharma and members of his Special Unit were at their station chatting over tea. For days they were idle with nothing much to do. One wiseguy suggested “why don’t we go kill some people, we need to test our guns”. Another guy said “we haven’t got medals for a long time it’s time we did something”. So they wrote the names of 5 localities with some addresses in pieces of paper and one of them picked the lucky draw. Well, the unlucky winner in the draw was ‘108 Batla House’. So the guys strapped their guns in the holsters and drove up to Batla and stared shooting and killed a few and some escaped. They were smart not to arouse suspicion this was a fake encounter. So Mohan Sharma took his gun, stretched and turned his arm 180 degrees and shot himself in the back; twice. This is the story the hacktivists would have you believe. The only change they offer is that another cop shot Sharma. So you have two options on how Sharma died.

I remember a scene from the movie “Analyse That” where the shrink asks the mafia wiseguy how he got out of jail and what happened to the strong witness. The wiseguy explains to him: “Oh the witness, he was frustrated… he stabbed himself in the back, twice, and then threw himself over a bridge into a river”. Yeah, frustrated people do stab themselves in their own back, not once but twice, and jump off a bridge. Quite plausible, isn’t it?

Arnab Goswami, in his usual style, let out a tirade against certain Human Rights hacktivists on their wrongful defence of potential and actual terrorists who shot dead a cop. On Times Now Ravi Shankar Prasad made an important and startling comment. He stated that some Delhi cops of the special unit mentioned to him that if Mohan Sharma hadn’t died they would have all been in jail because of the highly connected HR hacks claiming fake encounter and the Jamia Milia agitators. Does that shock anyone? It is probably true if you can see shades of the Ishrat case where the cops are in jail or on bail. Yes, if Mohan Sharma hadn’t died the cops would have been charged for a fake encounter by certain activists, bounty-hunting lawyers and political bitches. That is the level and reality of how the Congress-UPA has brought the country’s fight against terrorists. And they’ll scream “don’t politicise” when they have egg on their faces. It’s a very dangerous sign.

NDTV, true to their profession, were asking if encounters were justified and if the Batla verdict would impact other encounter cases pending in courts. This was a programme by Sunetra Chaudhury in the evening on July 25. What particular case could NDTV be referring to? Umm… Let’s see! If I were to make a wild guess I’d say the Ishrat case on which another political campaign of the Congress and assorted hacktivists rests heavily. The Ishrat verdict is not likely to come any time soon so Singhvi can hold the “don’t politicise” Ishrat verdict for the future. On TimesNow a certain Mrs. Ramalingam, another of those HR hacks, screamed “What about the rights of the common man”? Well, even if there are police raids I wonder if common men pull out guns and start shooting. I tweeted stating I would rather see people like Shahzad dead. They are not common by any stretch of imagination. If terrorists shoot and are caught the courts exist to deliver justice and it doesn’t go by the frivolous opinions of these HR morons.

Now, since the verdict held Shahzad, the lone captured terrorist, guilty of killing Sharma the hacktivists and his lawyers started a new tune. They claimed the court did not judge him as an IM (Indian Mujahideen) terrorist nor has it judged the encounter to be genuine. Okay, weeping venals, we will get to that part soon! There is something shocking that I learned only yesterday. It seems ANHAD (Act now for harmony & Democracy) the NGO run by Shabnam Hashmi and Harsh Mandar had filed a petition in the SC through lawyer Prashant Bhushan to seek a judicial probe as the Batla encounter was against a particular “Community”. Wow! So hate-engineer Shabnam Hashmi thought terrorists shouldn’t be countered if they are from a particular community. The SC naturally dismissed this bogus petition and even admonished the gang for trying to link the case to a particular community. They didn’t say it and the SC didn’t say it but ANHAD is clearly implying the Muslim community is being victimised. I call ANHAD: “Act now for hatred and disharmony” and I make no bones about it.

Now that the verdict is out the hacks, the defence lawyers and sundry agitators from Jamia Milia claim the court had neither judged Shahzad to be an IM terrorist nor has it called the encounter genuine. This is the deception that they are peddling to fool the nation. Here are a couple of tweets that @Spread_Law made on the case:

Mind you, I am only quoting SpreadLaw, a helpful handle which tweets on legal issues and provides clarity on judgements, and it is not part of any debate or controversy in the Batla case. So the question is why would a court pass a judgement on whether Shahzad is an IM, LeT or JuD terrorist when there was no such specific petition and no one asked the court for such a judgement? The case before the court was whether Shahzad killed Mohan Sharma in the encounter and the circumstances leading to it and not the flavour of his terrorist connections. Secondly, there was no petition in the court challenging the genuineness of the encounter except probably in the defence of Shahzad by his lawyers, so the court also did not have to adjudicate on that. The murder of the cop was the key issue in the prosecution. So the claims that the court did not pass judgement on these issues are frivolous and meant to deceive the public. Fact is there was no legal challenge on the encounter being genuine and therefore the court does not need to rule on it.

Courts usually rule on the petition before them. They don’t have to rule on petitions that were never made. And until someone specifically challenges Batla as fake, as the hacks have done in the Ishrat case, the encounter will stand as genuine. Period! As SpreadLaw points out, the court has made an “observation” which is substantial but even that was not necessary. Shahzad is indeed a terrorist of IM and the encounter is genuine unless someone legally challenges that position. If Digvijaya Singh felt the encounter was fake he and his gang should have challenged it in the courts. They did not because they too know there is no merit in their claim which is only for “political” gains.

The fake claims of the hacktivists are equivalent to claiming Al Capone was never a bootlegger and never a murderer because no court has ever pronounced him so. He was sentenced to prison for tax evasion which is the case the prosecution brought against him. That’s the nature of law. But everyone knows Capone was a mass murderer and a bootlegger. The campaign of lies and deception by the HR hacks and some politicians is not out of any sympathy for the likes of Shahzad. It is a larger design to weaken the country politically and compromise its security for enemy forces. These people and their deceptions are as dangerous as the terrorists themselves.

  4. I think congress was caught in its own game. 2009 verdict gave them the hope that it may finish off RSS/BJP in religious perception. Congress was successful in changing the narrative by including 'Hindu' terror angle in perception. But the continuous terror attacks and conviction of Muslims has allowed BJP to gain strength.
    No filing of chargesheet, till date on Sadhvi Pragya is making congis nervous now.
    All the comments on muslim victimhood for atrocities of their own state police is going to blow up on their faces.
    In eagerness of finishing off BJP, they will find themselves in real bad situation after 2014. They can just wish/hope/pray Modi doesnot become PM. Others can be managed. If Modi puts the efforts which was done to finish him politically, he can finish of whole first family and by extension congress.
    Game has just begun.

  8. These HR hacks always say What about common people... Let me share an incident that took place in Chennai last year. A gang of bank robbers were killed in an fierce encounter by TN Police in a residential area. From the next day onwards for many days, there was a long line of Common people at Police commissioners office to thank him for killing these robbers and ensuring their safety. Few days back TN high court in its ruling admonished these HR hacks for calling this encounter fake. Common people want their safety.

    1. Friend, pls dont blindly take up a cause bcos a Muslim was involved. Any1 can make mistakes, including Hindus. So, pls dont extend support blindly, to a group of terrorists. If the court has found him guilty, so be it. Just bcos there were anti-mortem injuries doesnt mean the encounter is fake!

    3. The fact that Sadhvi is still not chargesheeted or prosecuted should be a case as to why Javed's of India do not question cases other than their community. While Mukhul Sinhas question Ishrat cases too?
      Do you think the honorable court had not got into the evidence before pronouncing it. We hear everyday of the liberal muslims, but all we see on the political discourse is people like the above disrespecting the courts whenever the judgement does not meet their expectations.

  12. I just don't understand the muslim community, they still believe CON party is their saviour and will get them out of the morass they are in. They still don't realise they are being used and will be continued to be used till they die and then the next generation will be sold the same story and continued to be used by the CON party. It's not only them their are others also who gets used and thrown away like a tissue paper. A recent case is that Sanjiv Bhatt and his wife Shweta Bhatt. Does anyone remember them today. CON party used them for a limited purpose and today he and his family simply cease to exist for the CON party. Sooner the muslims realise this its better for them and let them be assured this country will exist only as a secular nation and nothing else as from time immemorial this country existed only as an open and secular society. That's why even the emergency couldn't last more than 2 years.

If each and every action of the law enforcing agencies against our nation's fight for terrorism have to see the days in courts of law then God only can save this nation. Like AFSPA, counter terrorism cells/units of Police forces / IB have to be provided with some immunity that would boost their morale in the fight against terrorism. At the same time there need to be some checks and balances to prevent innocents getting killed.

    Loved - ANHAD: “Act now for hatred and disharmony” - BJP should corner Khangress and show how Shabnam Hashmi was running her operations from Syeda Hameed's house, of Harsh Mander and of Prashant Bhushan and other NAC cronies. Let people know of NAC and its chairperson SG.

    BJP needs to up the ante big time.

    Yesterday saw one old video of Pramod Mahajan speaking in Parliament on Confidence Motion of Deve Gowda when Congress withdrew support. Great one

  17. Posting with a few correction.
    People of Batla House area protested against the court verdict. The terrorists killed in the encounter and the one arrested are/were not from that area, they are from the notorious town Azamgarh. Why this affinity? Muslim brotherhood? Even if they are terrorists? I think we need to start questioning such common-cause breast openly. The question I want to ask such people and their supporters in Human Rights Industry, most of whom are Hindus: Can love for the country be conditional? Of course these people are not even at the step before love,called loyalty. Can loyalty to the nation be with, "conditions apply"? All nationalists should start openly questioning and confronting these "conditional loyalists" of India more aggressively.

You have aptly explained the state of affairs in our country. From the times of Indira Gandhi congress always tried to weaken the country to be in power. In the times of Soniaji this policy of putting country`s interest at stake for political gains has following with much vigor. Foreign forces like US have giving enough support to Congress to implement this policy.

    I am just curious to find out when exactly did Hashmi and co. submit their petition? Please let us know if you do.
    The timing seems to play an important role in all such acts. A couple of days back, Vrinda Grover was strongly arguing with Mahesh Jethmalani about the Ghazwa Times having withdrawn its certificate to IJR from its website on 28th of July 2004, and not three years later, in 2007. She was trying to prove that the LeT mouthpiece did not do this to make it convenient for Javed Sheikh's Dad Mr. Pillai's plea about the fake encounter, which was filed probably in 2007. A little search revealed that if VG is right about the date, it perfectly suits to help IJR's mom's plea about a judicial inquiry that was done in July 2004, just a few days before the vociferously stressed date!

  24. Batla House Encounter Verdict is the single most weapon that destroyed SECULAR and traitor duo of Congress and AAP. Nationalist Hindus and Muslims will not vote for them now.

    For AAP to appeal to Indians again, Arvind Kejriwal must apologize to the nation and they must also expel Prashant Bhushan for anti-national and pro-Terrorist activities. Since both of these are unlikely, AAP's story is finished here.

I am not supporter of any group, but looking at the political influence over investigating agencies and limited scope for judiciary over investigation, I feel all the cases from 1984 riots, like of Mulayam DA case, or Ishrat or this batla,Salman Hit-run This alll cases are investigated only to give advantage to Congress(ruling Govt), Recently Bansal was not chargesheeted by CBI,who is ready made clean chit for Mulayam too.... what is credibility of any investigation in any case??? when politics are run by traitors,who preside over all investigation agency, similarly talking about this case, It may look to be in favor of police or someone else.. but certainly some congress leader is getting benefited by this verdict.. Then Why Only focus is on Gujarat encounter(8) and not on UP encounters(132)? why till date from independence of 3 ministers were punished? Is there no corruption here? So I doubt 90% of investigation involving ruling party..

    The congress seemingly in the last attempt to stay in the race, is throwing out taxpayers' money to the media and to the schemes like food-security bill etc..

  29. My problem with BJP and other well meaning media persons is that nobody is asking the right questions as being raised in this site. A few example will be in order

    FSB: Why there are so many poor living on Rs.27.50/day in spite of 60 years of Cong.rule and 10 yrs of UPA's.Have they fixed leaky PDS which will be used for food-grain distribution

    IJ Case:Why were different versions by GoI on IJ's role at different times.How many encounters have taken place in UP,Mumbai and other states. Let them all be put to judicial scrutiny. If they are fake,let the perpetrators face the music.

    Batla Enc.: If Digvijay was sure that the encounter was fake,why he didn't go to court(Point raised in this blog). Minorities ke liye itna to banta hai boss!

    26/11 : Digvijay hinted that it was an act by Hindus.No one asked him to explain his story/theory in full.

    Guj 2002 Riots : No one is asking 1) who started it 2) In how many days the riots were controlled? 3) How many Hindus died in the riots and police firing. 4) How many congressmen were involved in the riots. And comparing these figures with Genocide of 1984,Riots of Maliyana,Biwandi,Bhagalpur and so many others.

    On Congress frequently distancing itself from their party leaders for most stupid utterances by Shakeel,Raj Babbar, Some Khan et al and off course Digvijay. With this trend shall we assume that a day is not far when Congress party will distance itself from some comment of SG and RG saying these comments are their personal opinion and not Congress's official line

    So guys ask relevant questions and expose Congress

    PS: How can we allow leaders who are totally cut-off from ground realities (Rs.5 and 12 ka bhar pet khana) making policies for us.
