BSNL - Illegal Blockade of MediaCrooks

‘Connecting India’! That’s the tag-line of the government telecommunication company called Bharat Sanchar Nigam Limited (BSNL). Lately, it seems to do a lot more than connecting India. It also seems to secretly and illegally disconnect India. From the evening of July 17 I have been receiving messages, even complaints, from regular readers of this blog that they haven’t been able to access MediaCrooks. It was initially surprising since I was able to access it and I had posted a fresh article early the next day on July 19. I thought it must be some temporary problems with the connection or the service providers of those readers. 

Then the messages kept growing and on checking I found that all of these readers were using internet services provided by BSNL. On the evening of July 18 I put out the following message through a tweet stating options readers could use to access the MediaCrooks articles: (Please click and open tweet images on a separate tab and enlarge to read)

I chose not to assume BSNL had blocked MediaCrooks or that there was a Central govt order of any kind to ban this site since it was accessible to users through other Internet service providers in India. I have been able to access the site, review comments and post articles (including this one) without any problems. But it does appear that BSNL has blocked access to the site. I wish to state in no uncertain terms to BSNL or any govt authority that this site does not contain any content that breaks any law of the land, does not contain any pornographic material, it’s not a commentary on religion that can disturb peace and harmony or result in riots, it is not even political in nature.

The objective of the site is to critique and expose the Indian mainstream media. In that, it surely does include politics, politicians and other people and entities in the context of media and their reporting and coverage of issues. Does this site offend certain sections of people and entities? Yes, it probably does and delights in the consequence of its articles! It delights in criticising the media when they act in an indiscriminate manner, when they lie, when they distort facts. It offends media personalities for their glaring blunders and deliberate manipulation of facts. MediaCrooks delights in criticising politicians when they utter nonsense or appear to support injustice. This will continue and it will not stop.

I have not received any notification or information of any kind on whether BSNL has blocked the site and, if so, for what reason. Now that BSNL users have not been able to access the site for over 3 days it would be fair to assume that some govt official must have passed on a clandestine, unwritten and illegal order to BSNL to block the site. If the govt has done so and if BSNL has obliged them then both are in serious violation of the law and my rights to publish my views. I also presume there has been no advice to Google, which hosts this site, on any objections to the content on this site else I am sure I would have heard from them. Thus it seems quite obvious and fair to assume the illegal blockage by BSNL has been instigated by some govt quarters. They were probably unhappy over criticism of some official, minister or politician precious to the govt.

On July 20 I wrote the following email (cvo@bsnl.co.in) to BSNL requesting an explanation of this blockage. I await a response:

I publish a site titled www.mediacrooks.com. Since the evening of July 18, 2012 I have been receiving complaints from readers through Twitter and by Email that those who were accessing the site through the Internet services of BSNL have not been able to access my site. I would request you to note the following points:

1. The complaints from readers through various sources have raised suspicion that BSNL has BLOCKED access to my site as a Censorship act and measure.

2. Please confirm if the blocking of my site is true and correct. In case access to my site has been blocked I have to state that I have no intimation from any government sources or your own organisation for the same. I wish to add that blocking access to my site is illegal and breaches the fundamental right of free speech and access to such content.

3. My site is essentially a critique of issues in the Mainstream Media and does not in any way break any law whatsoever.

I would request you to restore access to my website for users of BSNL's Internet service. In case you still continue to block access to the site as suspected by many readers please let me know on what grounds and for what reasons such access is blocked. A screenshot of complaints that were noticed on Twitter is also attached for your reference. This is being written without any prejudice to my legal rights.

While I wait for a response from BSNL I wish to assure readers that they can access content of MediaCrooks through other options in my tweet mentioned earlier. I also wish to state that if BSNL has indeed carried out the blockage then we must estimate what a dangerous tool it is in the hands of the govt and politicians. This is a good reason why govt must not be in control of any business, especially not a communication organisation. It is clearly a grave danger in a democracy. This is not an issue relating to a single blog site. This does bear a serious threat to every blogger and writer. Am I going to stop writing? Fat chance! I must mention though, that if I do not receive a satisfactory response from BSNL to my mail the issue won’t rest. As govt officials, politicians, media and ministers are so fond of quoting, I will use the same line that they do: “The issue will reach its logical conclusion and the law will take its own course”. In the meantime, I have a modest suggestion for BSNL. “Change your tag line, Change it to Dis-Connecting India”!

Three Idiots In Ahmedabad

Suppose you were an idiot. And suppose you were a member of Congress. But I repeat myself. - Mark Twain.

Sure, Mark Twain meant the American Congress, the equivalent of parliament but then I’m learning to spin and in our context I’m also starting to think he meant India’s Congress party. It’s because I can’t think of anything else to describe why three idiots from the Congress landed in Ahmedabad on June 13, 2012. P. Chidambaram, Salman Khurshid and Ambika Soni landed in Ahmedabad (Gujarat) supposedly to boast of the UPA’s achievements in the last 8 years. The other undisclosed agenda was to challenge the achievements of Gujarat under Narendra Modi. They came too soon! Elections are still some months away.

And then talk about bad luck and bad timing. On a day when some of the national media too landed up in Ahmedabad the main story on all news channels was that of the Presidential election circus. Who screwed them? It was one of their own alliance team – Mamata Banerjee and Mulayam Singh, who snubbed Sonia Gandhi with their choices for President. That’s for the politics bit. The three wise kings were not about to talk to their subjects in Gujarat but to their ‘Inner-wheel’ club called the media.

Ambika Soni, the I&B minister, who is known to arm-twist media outlets (according to Aditya Sinha of DNA) made it abundantly clear to the folks in the theatre: “Ask the questions you were supposed to ask”. Of course, that’s like parents of students telling teachers to stick to the syllabus. So here are some highlights:

Salman Khurshid was unexpectedly asked about the Supreme Court refusal to stay the sub-quota for muslims which was earlier struck down by the Andhra High Court, which SK had earlier made an election bomb in UP, which was earlier criticised all around, which was earlier…. This was the Law Minister’s response: "Vacation benches tend to be conservative. We thought we will get relief but it did not happen. It happens at times... when the court reopens it will go to the regular bench where the matter will be heard before we get a final answer”. Oh okay, so vacation benches are conservative. I wonder what regular benches of SC would be like – Fascists or Secularists? So now you know when to go to the SC and what kind of bench for the verdict you want.

When a reporter persisted with his question on Gujarat’s development it was left to P. Chidambaram to answer. PC accepted the Gujarat development story but wanted to let the world know that the Centre had provided great help for the cause. What he doesn’t mention though is that much of the Centre’s resources to Gujarat comes from its own contributions and do not amount to doles given out to some other states. Read more at DeshGujarat.

And Ambika Soni had only one thing to talk about – Malnutrition. That malnutrition in Gujarat was higher than the national average. Point made. But she forgot to mention what Gujarat was doing about it. Worse, she forgot to mention what the Centre was doing about it. In a speech in Mumbai recently Narendra Modi had pointed out that the PM’s three year report about UPA-2 didn’t have any mention of malnutrition in women and children although he considered it a ‘national shame’. Jainarayan Vyas, minister in Gujarat, has challenged the figures quoted by Soni but malnutrition is hardly a matter of numbers game. Whether in Gujarat or the country it is a shame indeed.

Now, you would have thought that after the grand show of the three kings in Ahmedabad the front pages of Ahmedabad would be flooded with the blast they had. Well, instead the Times of India front page story today, the day after, is “It’s advantage Modi in Gujarat’s Kurukushetra”. That says a lot for the lightning media campaign of the three idiots. Worse, the TOI Ahmedabad edition doesn’t have a single word of this press meet on its front page.

Reminds me of the question the teacher asked the class: “Who were the three kings who brought peace and happiness....?” A thoughtful little Johny responded: “Smo-King, Drin-King and F**-King”.  I don’t know what the three idiots or their party smoke or drink but I would certainly hope they get to their jobs seriously and stop ‘F**king’ Gujarat and the nation.

Saving Shekar's Indian Express

The post ‘India’s Worst Journalists’ of August 2010 still remains a popular one on this site. That says a lot of what people generally think of our media celebs.Here’s what I wrote then about Shekhar Gupta, the Editor of Indian Express:"He is the chief of a fast-sinking newspaper and bides his free time (of which he has a lot) in a mundane program called "Walk the talk" on NDTV. Voters found a lot of similarities to BBC's 'Simpson's World' but lacking in any substance. Much of the interviews or discussions on this program is a platform to scratch the back of the interviewee. If you are looking for any serious questions or answers this is certainly not a program for you. In fact, some voters have very strongly suggested that the title of the program should  be called  'Time Pass”.

Ramnath Goenka must surely be having sleepless eternity where ever he is with the current state of affairs at the IE. A newspaper that was strongly anti-establishment, stood for courage in reporting and exposed many a misdeed has now been reduced to a doormat and mouthpiece for the Congress. One should read the series ‘Indira as Commerce’ by Arun Shourie which unseated A.R. Antulay as CM of Maharashtra or the IE stories of the Bhagalpur blindings which still stand as India’s best investigative reporting. All that is past. Today there are two IEs. One is Indian Express and the other is the New Indian Express. NIE has a decent circulation of around 2 million, mostly in the South while IE is negligibly sold mostly in the North and West with negligible circulation.

Kingfisher Airlines has been in the news for quite some time now with its financial mess. There was news about SBI willing to bail out Kingfisher but it backed off owing to protests by its own unions. So KFA is currently stranded with its wings clipped. If the Govt. were to step in and bail out KFA, that too is sure to generate a lot of heat and protests. I don’t have financial information about Shekhar Gupta’s IE but I have little doubt that it is being regularly bailed out and on oxygen supplied by the Govt. Of India (GOI). And since such generous doles to a newspaper are not clearly visible to the public, both the GOI and IE can get away with it. And the bank that bails out ‘friendly’ newspapers? Yes, it’s the Directorate of Advertising & Visual Publicity (DAVP). It falls under the I&B ministry, currently headed by Ms.Ambika Soni.

I get at least 3 newspapers of which IE happens to be one. I usually only browse through them as most of the articles and news reports are already on the net before the paper hits you. Let’s take the main paper of IE for Sunday, March 25. What caught my attention was a piece titled “Reinventing Rahul” by Lord Hairstyle Icon. In a cursory glance I found mention of Bollywood and Joy Mukherjee here and there and quit reading further. One of my wiser choices. But what was difficult to escape noticing were three whopping colour ads. Heavy, expensive ads going by the sizes. Not sure, but I am quite certain that this in all-edition ad for the IE.

The IE edition of March 25 has a quarter page of matrimonials, five tender notices from various govt. bodies filling up another quarter page. That’s it! No other real ads of any substance. Let’s get to the colour part of the ads. There are three in-house ‘filler’ ads of IE itself . After that, all that IE had were three whopping colour ads by none other than the GOI.

So what’s wrong with that? Well, none of the GOI ads aren’t about anything specific but a general awareness drive for ESIC, Ministry of Agriculture and Customs & Excise. Take a lot at the pics. If you were a commercial organisation valuing the money you spend on ads, would you really be advertising in the IE? With half-page and full-page ads? I seriously doubt that. But that’s not a problem for the GOI as it spends our money as doles for the friendliest of newspapers. I didn’t find the same ads in the TOI, which has a much larger circulation. So naturally, I wonder why this special love and affection by the GOI for Indian Express. Many in the business, even Aditya Sinha of DNA, will tell you how the DAVP works as a ‘Carrot and Stick’ organisation.

HalfPage ESIC Ad

It is for good reason that most media organisations have a special cell or people dedicated to managing and massaging the DAVP and State Information Departments. I have every reason to believe that in the competitive world of newspapers and TV it is hard to survive without GOI doles and bail-outs. This won’t be visible to the public eye therefore not as much outrage as a Kingfisher bail out. It is our hard earned money being spent mindlessly. All that a media outlet has to do is to surrender their soul to the Congress and their credibility to the devil. Staying alive is important. The GOI may be saving many other friendly newspapers and TV channels with our money. Saving Indian Express is one thing! Why should it be with wanton use of our money? The best part? One doesn't have to return these bail-outs, not even interest payments. It's free!

Forces Of Calumny

NDTV and CNN-IBN simply couldn’t have expected events that unfolded. When a carefully cultivated line of thinking and campaign goes terribly wrong it leaves one wondering which way to jump. Throughout August 17 as the Anna Hazare stalemate continued NDTV could only think of calling it a ‘circus’. Barkha Dutt kept tweeting about Alice In Wonderland and how this is all mad. Her late evening programme sported the tag line ‘protest or blackmail’ and an hour prior, Nidhi Razdan started her Left, Right, Centre by once again calling the event a ‘circus’. I couldn’t help laughing at the irony. When Barkha Dutt rushed to Egypt and Libya she didn’t find those events to be circus or the world of Lewis Caroll.  To Rajdeep Sardesai’s CNN-IBN, of course, must go the credit of inaugurating mud-slinging season. When a prominent news channel like CNN-IBN undertakes brazen mud-slinging it starts emboldening the forces and faces of calumny. The three stooges that were the faces of Congress in the entire Anna Hazare episode pretty much reflect the combined faces of calumny spurred by some in the TV news media. Rajdeep and Yogendra Yadav would be delighted to know how their recent opinion polls confirm everything they are seeing on the ground now. Oh yeah, if elections were held today the UPA would be voted back to power! That's what they would have you believe. And, of course, their poll suggested that only 28% believe UPA is corrupt. Will the truth ever set these media dealers free?

Faces of Calumny

Things didn’t go wrong on August 16. They went wrong on the night of June 4 when a peaceful crowd was lathi-charged in the middle of the night. I had then written that ‘Chidambaram, Sibal and Soni were the ones to have hatched the Anna arrest. But the people already knew that by now. What is worse is having a PM who has more or less abdicated his responsibilities and received a severe pasting from opposition leader Arun Jaitley.

The Congress and many in the media have tried desperately to spin these events as ‘parliament v street legislators’. Even that has failed. If the intellectuals in the media haven’t realised yet that no matter what Anna or Baba or Bedi do, they simply cannot make a law, the ordinary people are under no illusion. The best they can do is fast, agitate and protest. After the murder of journalist J. Dey did the media not demand special protection laws? Did they not demand that crimes against journalists be made ‘non-bailable’ offences? Is that not demanding laws that they want? The laws that Anna Hazare demands may be different but it’s not different in principle. He just seems to have more determination and the will to die for it. Fact is, journalists were demanding special privileges whereas Anna is not demanding any special privileges. But, that’s OK, people demand all sorts of things.

The most striking feature of the debates on TV is that people like Mahesh Bhatt, Nandita Rao, Rahul Kanwal question the wisdom or intelligence of ordinary people. I’m not kidding, here’s a tweet from Rahul Kanwal:

Quite certain protesters don't understand finer nuances of Anna's bill. Doesn't matter to them. They're livid with Govt over corruption.

Finer nuances? Alright, I can laugh but the media morons wouldn’t understand nuance if it kissed them in broad daylight. What they hide is that the crowds are just as angry with the media as they are with the politicians. I can safely vouch for the fact that there is not a single lawyer or constitutional expert who knows everything that they talk about. What they talk about is a common-sense stand that they take. These opinionated egos of media might be under the impression that every MP even reads every bill that is passed. Ordinary people just have a boiling point. They keep watching the crimes of those in power and when it reaches a crescendo they will come out and fight. They don’t need to read law books before coming out on the streets as some of our stupid media dealers seem to desire. And a man like Mahesh Bhatt believes without cameras the Anna Hazares would disappear. Without a camera it is the Barkha Dutts, Rajdeep Sardesais, Sagarika Ghoses, Rahul Kanwals, Arnab Goswamis who would have had to choose a different career and would be consigned to the bin of the thousands of unknown journalists. Bhatt’s statement is like an idiot cursing the very gift by which he earns his livelihood. Same goes for the media dealers who claim protests would die without the camera. This is the same belief that leads them to believe that they are indirectly the most powerful law-makers in the land. An offence they accuse the street protesters of.

Rahul Kanwal shouldn’t assume people on the streets are dumb. If he offered them a choice to listen to a moral sermon, between Anna Hazare and Barkha Dutt, I’m certain even Kanwal knows who they’d pick. And Hazare isn’t the cacofonix on TV screens every night. All said and done it is not Anna who has lost his sense of decency. The media should ask the PM if he has lost all sense of decency and let loose his ministers to take the actions they did. I doubt you need a constitution or law to tell you what common decency is. After all, the Ten Commandments didn't include rape or child-abuse. Common human decency helped us learn that.

In all this, conspicuous by their absence from the media are M/s. Hit and Run. Yeah, both Digvijay Singh and Rahul Gandhi must have run out of silly statements. The media must be dearly missing the crumbs that this duo is used to throwing at them. Tarnishing RSS doesn’t seem to be paying anymore. In Gujarat,  Gandhi is a name used to refer to the corner-shop grocer. That’s because Gandhis are traditionally grocers. There is a reason why Gandhi cared to understand ordinary people. The Gandhi-grocer is the one who interacts with ordinary people almost every minute of his working day. That someone like Rahul walks around with the name of Gandhi may not be his fault, but there is a reason why he has a severe disconnect with the people as does the media. And the most stunning comment on the man came not from his detractors but his ally in UPA-I. It was Brinda Karat of CPM, who for the first time sarcastically used the term ‘prince charming’ in parliament to describe the white-wash that the Congress attempted to make in the bungling of the Hazare incident. The Congress and media attempt to credit Rahul Gandhi with diffusing the crisis failed miserably. We had one great Gandhi who is now in heaven. We don’t need fake Gandhis in our parliament.

The PM who stupidly talked about ‘skeletons’ before the current parliament session is now warning Anna Hazare of consequences. His lack of decency and miserable failure as PM is embarrassing for the whole nation. When he indirectly condones the sacking of the nation and then lets loose his forces of calumny the nation looks for leadership. In the absence of a leader they found one in Anna Hazare. In less than 12 hours they have made him a national, and probably international, hero. This is a time to be humble. If the PM cannot find his own conscience then a Janlokpal bill will not be the only thing that the protesters will demand.

The Official Indecency Act

I would have liked to quote an Indian MP, but I couldn’t find a speech that is close. But here are excerpts from a famous speech to the US Senate in 1950, called the Declaration of Conscience speech (in blue),  by the late American senator Margaret Chase Smith

It is strange that we can verbally attack anyone else without restraint and with full protection and yet we hold ourselves above the same type of criticism here on the Senate Floor.  Surely the United States Senate is big enough to take self-criticism and self-appraisal.  Surely we should be able to take the same kind of character attacks that we “dish out” to outsiders.

I think that it is high time for the United States Senate and its members to do some soul-searching—for us to weigh our consciences….on the manner in which we are using or abusing our individual powers and privileges. I think that it is high time that we remembered that we have sworn to uphold and defend the Constitution.  I think that it is high time that we remembered that the Constitution, as amended, speaks not only of the freedom of speech but also of trial by jury instead of trial by accusation.

Those of us who shout the loudest about Americanism in making character assassinations are all too frequently those who, by our own words and acts, ignore some of the basic principles of Americanism:

            The right to criticize;

            The right to hold unpopular beliefs;

            The right to protest;

            The right of independent thought.

The exercise of these rights should not cost one single American citizen his reputation or his right to a livelihood nor should he be in danger of losing his reputation or livelihood… The American people are sick and tired of being afraid to speak their minds lest they be politically smeared as “Communists” or “Fascists” by their opponents.  Freedom of speech is not what it used to be in America.  It has been so abused by some that it is not exercised by others. The American people are sick and tired of seeing innocent people smeared and guilty people whitewashed.

There are those in our government and our media who follow an unwritten law. The Official Indecency Act. Chief among its practitioners are Congress spokesmen Manish Tiwari and Digvijay Singh. In the media you have the likes of Nandita Rao (CNN-IBN panelist) and again another Congressman V. Narayanaswamy. It does not take great intelligence to recognise these personalities as some of the most foul-mouthed people in the public domain. Yet the media delights again and again in putting them on your screens and in your drawing rooms. The filth that follows is unbelievable. The worst is character assassination, smearing and tarnishing of reputations and of course frequently calling others RSS agents and fascists, anarchists and Maoists.

Media doesn’t get to choose the spokespersons of the political parties. Yet they can choose who they invite on their panels. A Manish Tiwari maybe the Congress party’s choice. There is no need for the media to choose him on panels unless they deliberately enjoy the theatre of the foul-mouth. Same goes for those who invite the likes of Nandita Rao or Narayanaswamy.

In the current Anna Hazare stalemate, when asked if this was like the Emergency of 1975, Ram Jethmalani replied on CNN-IBN, that it is even worse. He explained that a court order had dethroned Indira Gandhi, there was a threat of her losing power, her government falling and therefore declared Emergency. But the current UPA is facing no such threat of any kind and yet chose to act in the most indecent and arrogant manner that any government in a democracy could. At the top of the pile is a Prime Minister who is simply lost and has proved to be the worst measure of lack of leadership.

So we had three stooges, P. Chidambaram, Kapil Sibal and Ambika Soni eloquently explaining how the government was not involved in the Delhi police decision to impose sec.144 and bar Anna Hazare from holding his hunger-strike and then making a preventive arrest. The arrogance and audacity with which they mislead the nation and attempt to whitewash their wrongs had to be seen to be believed. And then you previously had those that called Hazare an anarchist, a fascist and much earlier Ramdev was called a ‘thug’. What have these crooks taken the people for?

This was backed up by foul-mouthed media experts like Nandita Rao who has problems with Anna Hazare dictating terms on the Lokpal bill. There are also others like Tavleen Singh and some more. Now the issue at hand is first not the Lokpal bill itself. The issue has now turned into deliberately and illegally arresting individuals and denying them their right to protest. And the piety with which the three stooges defended the 22 obscene conditions imposed on Anna Hazare for the protest can only be described as a mockery of our constitution and mockery of our democracy. These people who cite our constitution, law and order are usually the ones who frequently abuse it. Many should remember that Ambika Soni herself has the Emergency to credit for her rise to prominence.

The Digvijays and Tiwaris have really gone a step too far in calling the agitators fascists and communal and being funded by invisible right-wingers. Fingers were pointed at pictures of Bharat mata or chants of Vande Mataram as proof of anti-nationals and right-wingers being involved in the protests earlier. Seriously, pictures of Bharat mata or chanting Vande Mataram are symbols of anti-national right-wingers and fascists? This time the scandalous crime that the Congress has tried to perpetrate has failed. Their propaganda stooges in the media have failed. No matter how much spin they tried, the NDTVs and CNN-IBNs failed.

The concept that parliament is the supreme law making body is certainly not misplaced. But the law makers need to be guided by ordinary people and not vested interests. The rulers in a democracy cannot rule without the consent of those being ruled. The one vote every five years is not a blanket sanction to pass any and all laws. It is particularly NOT a sanction to indulge in corruption and loot the nation. When that happens, parliament surrenders its supremacy and ordinary people must intervene. When that happens people power will definitely prevail over parliamentary authority. People power will definitely prevail when governments do what they have not been authorised to do by an electoral mandate. Corruption is one of those. What vote or what constitution has authorised our government and our MPs to indulge in such unprecedented corruption?

Those who call Anna Hazare’s demands for the Janlokpal as street laws are simply foolish. In a democracy every individual or group has the right to demand a law or demand the removal of a law. It is for the government of the day to discuss, negotiate and arrive at sensible solutions. The behaviour of the current PM is all the more reason why he should be under the Lokpal, but that is an altogether different issue. He should have stepped up and said “I am the Boss, and I will talk to you”. He did not. The people will then need to show the government who the boss is. Why only PM, I want even the media brought under Lokpal. One can prove any day that our media is not only corrupt that it is also a frequent law-breaker. Anna Hazare and company have not held railways, roads, buses and airlines to ransom or held up normal life to ransom unlike many other agitations have. To deny them the right to protest with absurd conditions and then arresting them is the last resort of a frightened, fascist government. And the government must and always should fear the people and not the other way around.

To back up their indecent and foul-mouthed statements, the Congress has now backed it up with indecent and unconstitutional action. If peaceful protests are drowned then violent ones are likely to follow. This UPA is quite clearly the most corrupt and dangerous government this nation has ever had. The media should also learn a lesson now that all their propaganda will not help when people power takes over. They need to really play the role of the watch dog. Foul mouthed politicians and activists should not be allowed an excessive platform in the media. The official indecency Act must die.

Stop Illegal Advertising!

 In my post ‘TV Pop-Up Ads: Fraudulent Invasion of Privacy’ on January 4, this is what I wrote:

“...TV channels must be free to make money during their commercial breaks. No one would grudge that. However, they should not be allowed to make money on your time. It appears the illegal practice is far worse than it appears. A watchful reader (Georges) wrote to me about the legal time limit specified for advertising on TV channels. According to reports the maximum time allowed for commercial advertisements is 12 minutes for one hour of programming. There can be hardly any channel that is not violating this norm gleefully. This is particularly alarming in case of news channels which are supposedly the watchdogs. Greed and absolute greed is the only driving force behind our media. TDSAT (Telecom Disputes and Settlement Appellate Tribunal) had sent a notice to the I&B Ministry in January 2011 seeking an explanation on this violation of Cable Television Rules.

The Tribunal's direction came over the plea of an NGO 'Utsarg', alleging violation by all leading broadcasting houses and channels by exceeding the limits of the commercial timing in their TV programmes.  (Business Standard). Much of the issues raised in my post on January 4 have also been covered in the petition by this NGO. And rightly so. It is time to protect the rights of the viewers.

The I&B ministry recently finalised new rules and guidelines that will become laws for the print media and are framing more laws for the digital media as well. Laws apart the ministry doesn’t really seem interested in enforcing any of these laws. Don’t be surprised if the next scam comes out from the very ministry that is supposed to regulate the media. Some ministries like Home, Finance, Telecom, Aviation are flamboyant by nature. The I&B ministry may not be that flamboyant but it certainly holds the same potential to generate as many scams as the others. Don’t wish for it!

TVS Wego - Mental Imbalance!

The Advertising Standards Council of India (ASCI) is a toothless organisation governed by corporate advertisers and agencies themselves. Thus, bad advertisements will continue to spam your TV channels endlessly. The new TVS Wego campaign is one such exercise. Some young females dancing or doing aerobics on two wheelers without helmets is not exactly a great model for your kids. All this is supposed to indicate ‘body balance’ of the vehicle. Sure, body balance supported by ‘mental imbalance’! Of course, don’t forget our advertisers simply love criminals. Salman Khan was dropped by CocaCola after the court conviction for killing protected animals and for the drunken hit and run incident. He should be in jail but he is happily in your face everyday doing dangerous stunts for a Pepsi brand. Far from expecting any ethical practices from advertisers and TV channels the least we can expect the regulators to do is to enforce basic laws and rules. The 12 minute commercial ad limit per hour must be enforced. The entertainment channels can pass off these ads. Why should news channels support such advertising?

Whether its body balance or mental imbalance, it sure is Ad nauseam!

TV Pop-Up Ads: Fraudulent Invasion of Privacy

Some years back during the severe earthquake in northern Pakistan and POK while reporting on destroyed houses and sorrowing families there was a scroll ad running at the bottom of the TV screen: 'Purvankara homes, the best homes in Bangalore'. Then again you might see reporting on a terror attack and then you might have a commercial break and suddenly up comes the Cadbury ad saying 'Kuch Meetha Ho Jaye'. Insensitive stupidity is one thing, but outright greed and invasion of your time are altogether different things.

And mindless greed has been the main principle of our mainstream media. If newspapers have turned their front pages into ad pages, the TV channels have gone many steps ahead. It is one thing to have commercial breaks during programs which, although annoying to the viewer, is a genuinely fair way of doing business, but altogether another matter when they force you to watch content. A commercial break warns you and you can switch channels or attend to something else. Mind you, lately the media crooks have also employed the tactic of turning up the volume during ad breaks so that no matter where ever you are in the house you can still hear the loud sounds. But that wasn’t enough. For more than a year now TV channels, particularly sports channels, have been airing commercial ads during the program itself. You could be watching a game of cricket, a documentary, a news discussion and suddenly you will be invaded by a PIP (Picture-In-Picture) ad, a pop-up ad or small banner type ads that suddenly flash across your screen.

These pop-up ads are a fraudulent invasion of your privacy. The programs you are watching are not free. You pay for them. With these pop-up ads and flash banner ads the TV channels are FORCING you to watch content that you should not have to watch. In a commercial break you are aware of what is on your screen  but these pop-ups force you to watch the ads because they are flashed in your face in the middle of the program. This is a fraudulent practice and both the ASCI and the Ministry of I&B must ban this practice to protect consumer interests. The least priority on the media’s list is the viewer.

Sometimes these pop-up ads can take up as much as 25-40% of your screen. The biggest violators of this kind of invasion are sports channels.

Viewers have experienced these monstrous ads appearing on their screens frequently, forcing them to watch the ads when they shouldn't have to. This is not what you are paying for.

Pics 2 & 3 above are from Ten Sports' live telecast of the India-South Africa test currently under way. In the pic on the left the Haywards logos appear suddenly on either side of the wicket/batsman as the bowler delivers the ball. Is this legitimate advertising or invasion of your time and privacy? In the pic on the right the Tissot brand is flashed as the bowler is on the way back. Mind you, Haywards happens to be an alcohol brand parading as a soft beverage. These are matches being watched by all age groups, including children. Such perverted advertising has to stop immediately.

TV channels must be free to make money during their commercial breaks. No one would grudge that. However, they should not be allowed to make money on your time. That’s the time you are paying for. Viewers should start sending complaints to the Ministry of I&B to ban this fraudulent and invasive practice. I have doubts if Ambika Soni is ignorant of these malpractices.
