Justice For 10000 Killed In Gujarat 2002



Aha! Now that I have got your attention with the 10000-killed number I guess I can spin some more. That’s like pulling out a number from the Worli Matka, isn’t it? For those who are new to the concept, Worli Matka was a major gambling racket operated by Ratan Khatri in Worli, Mumbai. Every evening Khatri would draw two sets of lucky cards from the pack. People who bet money on cards would either lose or lose. That’s true, people mostly lost and Khatri made a lot of money. There’s even a fun site called Matka.Com that educates people on the concept without money being involved. But since Khatri closed down a long time ago our media and others have carried forward his gambling concept. This is especially true for the number of Muslims killed in Gujarat 2002 riots. You must have heard numbers like 5000, 3000, 2000 while the official number was 1044 killed and around 223 missing. So, apart from the media, the latest one to use Matka figures and Matka logic is none other Justice Markandeya Katju (MK).

By now most of us have heard of MK’s opinions on almost everything under Pluto. And everyone is tired. So thankfully, like Aaakar Patel and Ram Guha, MK has chosen to “Focus”. And lately his focus is none other than Narendra Modi. He writes in the The Hindu an article called “All the perfumes of Arabia” on February 15. Now, I’m one of those who Katju categorises under 90% fools or idiots so I can’t figure out that title except that it must have to do with some fairy tales we usually associate with Arabian Nights. This time, it is nice little fairy tales about Narendra Modi. There is nothing new in what MK writes. So we will skip the usual rants about Modi and Gujarat and touch upon anything that sounds different. Like Shekhar Gupta who often runs into and chats with people at airports, railway stations and flights, MK starts with a conversation on a flight. Imagine the misfortune of his co-passenger. Let’s read the rant (edited excerpts in blue):

I was flying from Delhi to Bhopal recently. Sitting beside me was a Gujarati businessman. I asked him his opinion of Mr. Modi. He was all praise for him. I interjected and asked him about the killing of nearly 2,000 Muslims in 2002 in Gujarat. He replied that Muslims were always creating problems in Gujarat, but after 2002 they have been put in their place and there is peace since then in the State. I told him this is the peace of the graveyard, and peace can never last long unless it is coupled with justice. At this remark he took offence and changed his seat on the plane. Oh there you are! That Matka figure of 2000 comes in again. I’d have to say this co-passenger was a lucky guy indeed. He could get just get up and walk away to another seat. What if Katju moved in as my neighbour? Frankly, given his continuous outrage on everything and since the 90% can’t live with the 10%, I would definitely considering moving to a new residence which is far more difficult than changing seats on a plane. So MK is so obsessed he probably goes around asking every Gujju he runs into about Modi and then pounds him with his philosophy of justice. Just the other day I ran into a Supreme Court lawyer and asked him his opinion of Katju and he said… No, never mind! I can’t print that.

To call the killings of Muslims in 2002 a spontaneous reaction reminds one of Kristallnacht in Germany in November 1938, when the entire Jewish community in Germany was attacked, many killed, their synagogues burnt, shops vandalised after a German diplomat in Paris was shot dead by a Jewish youth whose family had been persecuted by the Nazis. It was claimed by the Nazi government that this was only a ‘spontaneous’ reaction, but in fact it was planned and executed by the Nazi authorities using fanatic mobs. This is probably the biggest blunder that MK has so far committed in print. The stupid analogy he draws seems to have been totally lost in his prejudiced head and thoughts. The closest that comes to the Nazi reaction he quotes for one single individual being killed is not Gujarat but Indira Gandhi. Because her Sikh guards killed IndiraG, thousands of Sikhs were brutally killed, homes burnt and families destroyed. I suppose Katju probably thinks the killing of one individual (IndiraG) caused a “spontaneous” reaction but burning and killing of 59 people in a train brought about a “planned” reaction. Sheer nonsense as his own example proves. If we apply his Nazi logic at all then it is the IndiraG murder that caused the Nazi reaction he talks about.

In terms of historical evolution, India is broadly a country of immigrants and consequently, it is a land of tremendous diversity. Hence, the only policy which can hold it together and put it on the path of progress is secularism — equal respect and treatment to all communities and sects. This was the policy of the great Emperor Akbar, which was followed by our founding fathers (Pandit Nehru and his colleagues) who gave us a secular Constitution. This is a pet theory of MK; India being a country of immigrants. Yeah right, most people know I am from Honduras. There’s no problem with the diversity, it existed even before and will exist after MK. The truth is, historically some immigrants came as refugees some came as invaders. Some invaders carried swords and some carried guns. Surely, the immigrants of the latter category didn’t come here singing “Kaho naa pyaar hai” did they? As for Nehru’s vision – China, NAM, Kashmir, USSR... less said the better. And no, the founding fathers (if they can be called that for an ancient country) didn’t insert the word “secular” into the constitution. It was inserted by IndiraG during Emergency. The secularism practiced by Nehru’s party is now prominent as pseudo-secularism.

So what’s new about the Gujarat and Modi story that is now floating in the media? First the media mafia started with the story of “Mass murderer, Hitler, Nazi, Fascist, Hero of Hatred, Maut Ka Saudagar” and FAILED. The more they ranted, the more the people backed Modi. Then having failed with that they showered scorn on Gujarat’s economic progress under Modi. They abused economic data to manipulate reports and show a bad picture. FAILED! Left with nothing, they have now come up with one single word mantra: “Malnutrition”. As MK says:

Questionable progress: Today, 48 per cent of Gujarati children are malnourished, which is a higher rate of malnourishment than the national average.

Like a box of parrots, Aakar Patel, Ram Guha, others and now MK, everyone in the media lately talks about “Malnutrition” in Gujarat. Even students who are called for debates are tutored to talk of “Malnutrition” in Gujarat. Funny huh? Malnutrition is a national problem and so too in Gujarat, maybe across the world in some countries. But where the other tags failed they are now into the “Malnutrition” song and dance routine. Here’s how their mundane rant has become and how foolish it really sounds:

Great roads in Gujarat:  Okay, but what about malnutrition?
Great infrastructure in Gujarat:  Okay, but what about malnutrition?
24X7 Power supply:  Okay, but what about malnutrition?
Water in Sabarmati:   Okay, but what about malnutrition?
Special incentives for girls:  Okay, okay, but what about malnutrition?
Crores of investments:   Yeah alright, but what about malnutrition?
Women can move safely:  Who cares? What about malnutrition?
Modi is not corrupt & incorruptible:  Corruption is normal, what about malnutrition?
Sex-determination tests banned:   Minor issue, what about malnutrition?
GDP growth over national average:  Fine, fine, what about malnutrition?
DoubleDigit Agri growth for years:  See the “larger” picture, what about malnutrition?

So, now that everything else has failed the last straw to clutch is the magic word called malnutrition. And I promise you, you will hear this word over and over again in the next one year. I can understand the agenda of the media mafia but considering MK is a lawman one would have expected a more logical and sensible approach with his criticism. Nothing like that! He too sounds like a parrot. So whether it’s 2000 or 3000 or 5000 killed as these magicians keep pulling out from their hats, what’s wrong if I pull out a Matka figure of 10000? For that matter, what’s wrong if I pulled out a figure of 1 lakh even? There are some newspapers and TV channels who are as good as a Matka. They provide the platform for the Matka logic and some writers are the cards.

  1. Good one. The good thing about Justice Katju he does not attempt to cloak his prejudice. It is all out in the open. Not a singe article or post from him ever criticises anything about the central government or UPA. For him corruption is not an issue; rape is not an issue,.....and he has many admirers who applaud him for that. No wonder he says 90 % Indians are idiots.

    1. Yes, Katju has many issues, yet nothing is an issue for him.

      You see, he is a true secular. He would have made the death of 59 karsevaks in Godhra an issue if Muslims had burned them, but as brother judge Banerji has proved beyond any doubt, these idiots calling themselves Rambhakts shut themselves up in the bogey, S-6 and committed mass suicide by exploding petrol stoves.

      Similarly, the 3 lac Kashmiri pandits' leaving the valley in a hurry would have been an issue for him if the Muslim jihadis baying for Nizam-e-mustafa had driven them out. But, you see, these bloody, stupid pandits were bitten, en masse by the migration bug. Is India not a country of immigrants? Pandit Katju himself says so. So what if the pandits moved, peacefully, from Kashmir to the jhuggies and jhompdies of Jammu, Delhi and elsewhere?

  3. Almost anyone higher up in GOI is somewhat compromised. Even if they are honest they would have been in the chain when it was being greased. As a result, the durbar now has an entire set of fall-guys available.

    If they do not toe the boat for the durbar, the durbar will send CBI, SIT, ED, IT & assorted other arms of the state after them. If they toe the boat they remain in the good books of the durbar.

    Like the USN's Carrier Battle Group (CBVG), these compromised darbaris provide a shield for the aircraft-carrier (CV) . If some scam tries to weaken the CBVG, the darbaris will either defend them tooth & nail, or take one for the CV, and do some jail-time. But the Carrier sails on.

    The above gives the impression that 1044 muslims were killed. However, 1044 was the TOTAL casualty count, which included 254 Hindus too. Muslim casualty count was 790.

      In his article Katjus also mentions "no justice" for Godhra and after, even though many have been sentenced, some to death.

      That number I quoted is just quoted as a total figure and not to point out any reason. After all, we are talking Matka figures. Haha!

      I found him very funny when he compares Modi with Shivraj Singh, He was praising Shivraj Singh for attending some Urdu poetry function and staying more than 15 minutes as Shivraj had promised he won't be stay beyond 15 minutes and extended his stay and enjoyed Urdu poetry.
      He judge the secular credentials of any CM by just merely attending some Urdu Poetry Function. What can we expect from him for Gujrat especially.... I really feel very much disgusting that nowadays it has become trend of Hating Hindu's to establish Secularism...

  5. If he was still a supreme court judge dealing in some case related to Gujarat and at the same time carrying such an anti-Modi bias, what kind of justice he would have given. Now I get an idea why poor Modi lose all his cases in court. Another question is why do judges/babus and IPS are given key government postings just after their retirement (justice Hegde went after Yeddy with no comments on SM Krishna,Moily etc.).

  6. brilliant and terrific response to the senseless article by Katju in TheHindu, clearly showed his hatred towards NaMo for no reason, Ravinar have you noticed one thing, the people who constantly insult and abuse Modi in public forums, for example, Javed Akhtar, Shabana Azmi, Katju, barking Dog Manish Tewari, Modi obsessed MANIAC Aakar Patel, to name a few, all these names which i have mentioned above, not once have i heard NaMo saying anything against them or even unknowingly ever make a passing remark on these people, still these people say all kind of dirty things about Modi with no proof and substance, its like they being unleashed from CAGE to do only one task day and night speak only about Modi and that too dirty and abusive language, i hope majority of INDIANS realise the conspiracy around targeting Modi, i hope GOD gives more strength to NaMo to survive these attacks and we Indians strongly stand behind NaMo, JAI HIND

  9. I've always said this: Katju is a crazy cashew-nut and is given too much media space to air his crazier views, by virtue of his current and previous position. All the rubbish he has been spouting over the past couple of years would have ended a political career, even in India. Or maybe not.

    But he seems to be angling for a new government paid job after the PCI stint is done. The best way to earn that, apart from more media exposure by our beloved channels, is to bash Modi.

    He should be made Defence Minister. And then:

    "90% of the tanks in the army are idiots".

    Nations won't dare get into a war with a country that has a lunatic for a Defence Minister. Arms expenditure reduced!

No wonder why Media go back 10 years time and again, as there is no other issue which they can go ahead with...unlike congress which give them new opportunity every now and then, but there too instead of targeting the govt. some media is busy in getting govt. out of that mess. media is Most influential entity in India and apart from few educated and updated people ( who are very less in nos) rest of the Indians get fooled by this crooks in media..

      I am saying this again, but we educated Indians ( Young & Old) must form an assembly-wise local groups throughout India. We can surely create an Impact amongst common citizens of this country during elections by explaining them the devious & dubious Media-Congress nexus against Modi. Even if we are able to bring 1% new voters to vote, it can swing a few dozen lok-sabha seats. Atleast I am going to do that in my locality by taking a 1 month paid leave from my work before elections. Its now or never guys. Jai Hind!

About Nehru, the less we talk is good. I don't want someone telling me that his/her legal team will contact me. :)

    But the article is spot on. More media talks about Modi, they give him more free publicity. The raise more questions, but in the end public start asking relevant questions which makes media uncomfortable. I just want to see that how long will this media save 'G' family. And with 'G' i'm not cursing at all ;)

  16. Ravinar. Good point about Nazi congruence with Sikh riots. In the backdrop of Afzal Guru's hanging and the subsequent trial by media and subjugation of the authority of Supreme Court and the judicial system of India, I thought at least Mr. Katju would have some respect for the parliament and the reply in Rajya Sabha by Congress about the the dead(790 muslims, 254 hindus). In this age of information, how difficult can it really be to go to Wikipedia. However, his trust not on Rajya Sabha declaration says a sorry state for the people encumbered in judicial system.
    As far as the state complicity and lack of police forces go, if we go a little into history we will come to know how devastating a riot can be without any forces. On 'Direct Action Day' on 16th august 1946 with negligent police force in Calcutta, 4000 people died within 72 hours. The Brits were in a hurry to leave the country. And riots were well and truly without any force of law on land controlling it. Assuming 'secular' Brits, it also shows how terribly difficult it can be to control a riot. And how devastating a riot without control can be.
    Gujarat riots were simmering for months. Going by the wanton orgy exemplified by the Calcutta riots, if there was no state control, or rather state complicity, we would have the shame of biggest ethnic cleansing in world in our hands.
    However, given 194 of 254 hindus died of police firings and 59 in Godhra train mishap, one has to give that riots post Godhra were Hindu only mobs on a killing spree. That Muslims by and large post Godhra were not part of ideology behind Godhra and in spite of severe instigation, never were the aggressor.

    I was also discussing with a Retired Chief Justice in a Media School Innaugural function (Not throwing my weight, I really did. LOL!) During the refreshment break time, I mentioned Katju and he simply said - beneath me to discuss about Brother Judge even if he is most Incompetent & "Inconsistent (I guess this word was used in the sense that he has gone nuts)"

    Land of migrants - He was sired by Amerigo Vezpuzzi? and unlike Americans/Australians (he forgot that) we are the oldest civilization. Realize now that "Senility" is a curse to the humankind (especially for those who are not struck by it).

  22. I think Katju is quite crazy. Actually judges are expected to be balanced, in service and out of service. But he seems to carry several biases. I wonder whether there will be a move to have a relook at some of his judgements! We being a nation of immigrants is the strangest statement. If ur from Honduras, I'm from Hinduras :-))

  26. We can never forget Katju. He was the man who set free the Marxist killer gang who barged into a school classroom and murdered the teacher right in front of the eyes of the children. The incident took place on December 1 , 1999 at East Mokeri School in the Killing fields of Kannur, Kerala. The man who was murdered : Jayakrishnan Master , BJP Yuva Morcha leader. The lower courts, including the high court of Kerala had sentenced all six killers to death and Katju set them free. THE KILLERS WERE GIVEN A PUBLIC RECEPTION BY THE CPM AT THE SAME SCHOOL WHERE THEY HAD KILLED THE BJP LEADER.

  28. Even the malnutrition claim is overhyped. I read somewhere that many vegetarians in Gujarat are wrongly branded as malnutritioned. Those who did such surveys must have had biased opinion against Vegetarianism.

When you have no other designated work to do, you will pry on your neighbours compound and even if you do not see anything there, you start imagining things, say that his wife is having an affair with mr. so and so like. Here the problem could have been solved if, MK do some compulsory toiling work like masonary work in a constructions site or bringing water in a drought prone area or cleaning the streets etc.etc. Since he is not fully engaged in any constructive work, it is our folly to see his blabberings often. And the statistics of the death in 2002 Gujarat riots, as MK to count the figures of Hindu massacres since the advent of M.Gazni, Baber, and co.

  32. Morons don't understand or they like to ignore that malnutrition in Gujarat has to do with the state largely being vegetarian state where people don't consume diverse veg sources full of vitamins, minerals and all.

    For ex, spinach is high in iron. How many Gujaratis eat spinach and how many days ? So Iron deficiency is very normal in Gujaratis. Omega3 which is very imp fatty acid for brain development. Veg source of omega3 is seaweed, sea plant, flex seed... How many Gujaratis eat these sources ? Vitamin B complex(B1, B2, B6, B12) which is very imp for blood cell development has rare veg sources like cheese, soy milk, yeast, sea vegetables. How many Gujaratis eat these ? All these are easily available in meat, eggs, seafood.

    That is the reason most Gujaratis are malnourished not because they don't have money but because they are not well informed when it comes to veg food.

    This Katzoo is so fatso, that we can cook him and supply as supplemant food to remove Mal-nutrition of Gujarati's for 100 years.

    If I was sitting next to him, would have given him two fi$$$e salute and asked him to stick it up his $$$. But then, he was lucky that day.

Modi has to be watched for the next few years. but i agree with katju when he says development has to include the standard of living of the populace. i do not want to comment on 2002, because riots and killings happen under every administration, the only groups to be blamed are right wing extremists of every religion. if modi is able to take care of the poor in his state like he claims and what sunil alagh thinks modi will do, then definitely he is best suited for the post of PM. For that he has to produce results, evidence, which i think modi will do, and that will shut everyone up. If in a country where farmer suicides are at the rate of 1 every 30 mins, he manages to change the scenario, then he will be unstoppable. almost all administrations since 91' in the name of capitalism have screwed the poor. When modi changes that then no one can touch him. that in my estimate will take some time. if not 2014, probably in 2019. till then enjoy the scams, rubbish media and vote bank politics.

    2. Agree completely with Dinga. Modi has to give clear evidence that he is a good administrator. Yes, he has proved in Gujarat that he can provide good governance, though as the honorable justice says, malnutrition is worse than Somalia. But let us cut him some slack. My bigger problem is that Gujarat is not India. Therefore, I suggest that Modi prove his capability to rule India by becoming the CM of each Indian major state for a couple of years and prove that he is equally good in differing socio-political scenarios. Also, he must rule at least half the states as part of an alliance to prove that he is good at handling alliance politics. After this, we might consider him for the top post, of course, provided Mal-nutrition in Gujarat by that point gets close to secular standards - that is non-negotiable.

      Meanwhile, we have Rahul Baba. He does not have any record of governing even a municipality. But that is a minor flaw - he comes from the Great Dynasty which has ruled this vast and complex country so brilliantly for most of the last 6 decades. Good Governance is in his genes. As even the great Katju - who precisely calculated that 90% of Indians are fools - himself will agree, trusting the Dynasty is probably the only thing this foolish country has been smart about. I particularly like the way he has very cleverly hidden his leadership skills for such a long time. He is of course saving it all up for his stint as PM - brilliant, no? It is not clear what exactly Rahul's economic and development philosophy, you say? As a Katju fan, I have simple, logical answer to that. Go check Gujarat's ml-nutrition levels, its worse than Somalia.

  50. I was in Ahmedabad during 1986-88 and what I am narrating is my personal experience. I was in the old city shopping for goods one evening when I heard cricket commentary blaring from transistors from most of the shops there. I knew that India was not playing anyone then and was quite perplexed by the enthusiasm for cricket in the area till I realised that Pakistan was playing England! A few days later, there was a newspaper article that 2 people had died in Ahmedabad due to disturbances when England beat Pakistan in the one-dayers of the same series. And India was not even involved! I always knew that Ahmedabad was a ticking time bomb and unfortunately the trigger was Godhra when NaMO was ruling. I am sure that if Congress was ruling Gujarat at that time, the outcome would have been the same, if not worse. What happened in Godhra was wrong and what happened thereafter was also wrong, but to pin the blame on NaMo is to ignore the non-mainstreaming of the Muslim community for petty political gains by the Congress over decades.

    While I believe that most Muslims are decent folks, the appeasement of the community over time by Congress (without any real concern for them and with evil-intentioned vote-bank exploitation in mind) has ensured the radicalisation of some sections of the community. The molotov cocktail brewed by radicalisation, illegal-but-deliberately-legalised immigration, false propaganda of majority communalism will ensure that India will remain a tinder-box unless we all wake up to the machinations of the Congress and the MSM and work towards a resounding defeat of the party in the next elections. Congress has to go along with the family. The family is a curse on this country and the faster we do something about it, the better.

  59. If Markandeya Katju is a retired judge from supreme court, I do not know how the justice is delivered in that Supreme Institution in India. If he was the judge in supreme court, I do not know what his fellow judges felt about him or how they could manage with him. Or are they also travelling in the same boat?

    We the people in 90% category are of the opinion that Supreme Court is one last institution, that yet to be dismantled by Congress, but with the quality of judges as represented by Mr. Markandeya Katuju suggests otherwise. I think Mr. Kapil Sibal, Manish Tiwari, P. Chindambaram are on that job. That is why MK could get such important post to vomit his biases.

    Chairman of Press Council of India is a constitutional post, and if, Supreme Court feels it should not be judged on the intelligence of MK then they should take suo moto action to remove him from his constituational post. He will never resign as Arun Jaitly has demanded in his article.

Congress knows art of divide, rule & making non issue a issue so greatly that I think it might be one of the compulsory subjects in 100Cr budget which Congress is spending through likes of Sanjay Jha.   62. I really like all of your articles. It makes for good reading and especially reflects how I feel about the political situation in India. I am living in Silicon Valley for the past decade, however, I actively follow the news from India. I don't however react as angrily as I used to when I hear some of the comments made by some of this so called 'liberal' media. The mere fact that your page has been viewed a million times is sufficient proof enough of the kind of support that your articles have and how the hoi-polloi agree to your evaluation of issues. It seems to me like a revolution of sorts brewing and it has my full support. Hope that this can materialize into a kind of news channel of sorts whose true motto would be to move away from cricket and film discussions to real unjaundiced, unadulterated reports and rediscover journalism which seems to have lost its way in India. Kudos and my best wishes for that.

I stopped subscription to the daily news paper and not going to their free online paper (why to waste my mouse clicks :) ). My news sources are very limited (like a very few politicians in India :) ). These include DailyPioneer.com , NitiCentral.com , SandeepWeb.com, MediaCrooks.com and NaturalNews.com (for natural health news).

    We have to hit anti nationals where it hurts them. By stopping the "The Hindu" subscription you are helping India and the environment at the same time :).

    Just read an article by Kanchan Gupta in Niti Central on 20th Feb about Gujarat's development under Modi's government. He has systematically dissected a report from "Frontline" written by some Lyla Bavadam. What hit me the most is :
    1) We cannot compare Gujarat's development with any other state because Gujarat was a drought ridden state unlike Punjab & Haryana & without any natural resources unlike Orrisa & Jharkhand.
    2) Similarly you must compare its Human indices before & after Modi's rule to understand the exact improvement during his tenure.
    3) Modi has never declared that Gujarat has already become a Developed state but is only talking about his initiatives in past 10 years & progress achieved. Its a state which still needs a lot of development but under leadership of Mr modi its possible that malnutrition shall also be soon overcome.
    4) Hence Letist Fiberals who are trying to discredit Modi's Leadership & Governance can no longer fool the common man.

    Although I am deviating from Topic, but I find the comments made by Salman Khurshid " Italian authorities refusing to share deal documents" as complete hoax. Why would some country such as Italy not co-operate with India to unravel a fraud/corruption ????? I sincerely believe the Congress Govt is using CBI to pressurize the Italian Govt to bury the records in a hurry ! SHAMEFUL.

  75. I was a great fan of THE HINDU until N.Ram took over as Editor-in-Chief. I have stopped reading ever since 2003 because of their pseudo-secular, biased reporting & views and switched over to The New India Express. The English sucks compared to THE HINDU but my conscience is clear and my BP doesn't rise reading the hypocritical reporting and views of THE HINDU.

  76. I just came across this article of yours. I really liked it but I just have one clarification to make. When Justice Katju says 'Pandit Nehru and his colleagues gave us a secular Constitution', he is right. What your reply was that the word 'Secular' was not inserted by our founding fathers. When did Justice Katju say that Nehru and all inserted it?
    It is known to everyone that Indira Gandhi did it by the 42nd amendment in 1976, but you must know that the Constitution was considered to be secular even before that. In the historic Keshvananda Bharti case the Supreme Court held that our Constitution is secular and a basic feature of the constitution. That means our Constitution was secular since the time we adopted it... and it was secular only because of Nehru, Ambedkar and others... This is why Nani Palkhivala, the great jurist said that 'by inserting the word 'secular' in the Preamble, the Constitution has been defaced. We were already secular.' He even wrote in his book that it was a strategy adopted by Indira Gandhi to woo the voters.. Therefore, I think that it would be wrong if you would say that Nehru and others didn't contribute to make the Constitution secular. (see Articles 25-28 and 44. They are there since the time the Constitution was adopted)
